These Terms of Service (“Terms”) govern use of the ChangeOrder mobile app, the ChangeOrder website, and the homeowner-facing change-order signing page (together, the “Service”), operated by ChangeOrder (“ChangeOrder,” “we,” “us”). By creating an account, signing a change order through the Service, or otherwise using it, you agree to these Terms.
ChangeOrder is a tool that helps contractors capture a described scope change, price it, get it signed by a client, and generate a PDF record of the signed change order. Clients/homeowners interact with a signing page via a link sent by the contractor — no ChangeOrder account is required to sign.
Contractor accounts are created and authenticated by email (including magic-link sign-in) or supported third-party sign-in. You're responsible for keeping your account credentials secure and for all activity that happens under your account.
ChangeOrder is offered on a subscription basis, typically with a free trial period during which no payment method is required. After the trial, continued use requires an active paid subscription, purchased and managed through the Apple App Store or Google Play and processed via RevenueCat. Subscriptions renew automatically unless canceled before the renewal date; cancellation, refunds, and billing management are handled through the app store account used to purchase the subscription, subject to that store's policies.
You agree not to use the Service to:
A client who receives a signing link can view the proposed change order and choose to sign or decline it. Contractors are responsible for the accuracy of the information they present to a client through the Service. ChangeOrder is not a party to the underlying construction contract or change order between a contractor and their client.
Signatures collected through the Service are electronic signatures. Under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN Act) and comparable state law, an electronic signature carries the same legal weight as a handwritten one when both parties intend to sign. Each signature is stored with audit metadata (timestamp, IP address, device/browser information) tied to the specific document that was presented at the time of signing.
ChangeOrder is not a law firm and does not provide legal advice. Documents, templates, and PDFs generated through the Service — including the change orders, scope descriptions, and any guide content on this website — are provided for general convenience only and are not a substitute for advice from a licensed attorney familiar with your jurisdiction and contract. You're responsible for making sure your use of the Service complies with the laws and contract requirements that apply to your business.
ChangeOrder and its licensors own the Service, including its software, design, and branding. Contractors retain ownership of the content they enter (job details, photos, descriptions) and grant ChangeOrder a license to store, process, and display that content solely to provide the Service.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that any change order generated through it will be enforceable in every circumstance.
To the maximum extent permitted by law, ChangeOrder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
You agree to indemnify and hold ChangeOrder harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or content you submit through the Service.
You may stop using the Service and delete your account at any time from the app's settings. We may suspend or terminate access to the Service for a violation of these Terms or for any reason with reasonable notice, except where immediate action is necessary to protect the Service or its users.
These Terms are governed by the laws of the jurisdiction in which ChangeOrder operates, without regard to conflict-of-law principles. [Jurisdiction to be filled in by counsel prior to publication.]
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the “Last updated” date above.
